The first set of Ministerial Instructions was issued on November 28, 2008 and came into effect immediately. (Operational Bulletin No 089, December 2, 2008.

On June 18, 2008, the Immigration and Refugee Protection Act was amended to give the Minister of Citizenship and Immigration authority to issue instructions that would ensure the processing of applications and requests be conducted in a manner that, in the opinion of the Minister, will best support the attainment of immigration goals set by the Government of Canada.

The first set of Ministerial Instructions was issued on November 28, 2008 and came into effect immediately. (Operational Bulletin No 089, December 2, 2008.

Here is the excerpt of Bill C-50 :

 

(2) The processing of applications and requests is to be conducted in a manner that, in the opinion of the Minister, will best support the attainment of the immigration goals established by the Government of Canada.

Instructions

 (3) For the purposes of subsection (2), the Minister may give instructions with respect to the processing of applications and requests, including instructions

 (a) establishing categories of applications or requests to which the instructions apply;

 (b) establishing an order, by category or otherwise, for the processing of applications or requests;

 (c) setting the number of applications or requests, by category or otherwise, to be processed in any year; and

 (d) providing for the disposition of applications and requests, including those made subsequent to the first application or request.

Compliance with instructions

 (4) Officers and persons authorized to exercise the powers of the Minister under section 25 shall comply with any instructions before processing an application or request or when processing one. If an application or request is not processed, it may be retained, returned or otherwise disposed of in accordance with the instructions of the Minister.

 

Minister Kenney had announced that :


Federal Skilled Worker applications received on or after February 27, 2008

The Ministerial Instructions apply to cases submitted on or after February 27, 2008. Visa offices will assess the applications received on or after February 27, 2008 against the Ministerial Instructions to determine whether applicants are eligible for processing (see section VI below). Applications which are determined not to be eligible will receive a full refund. Those determined to be eligible will be processed on a priority basis. Guidance will be provided to visa offices by International Region as to the time lines within which these cases should be assessed (for eligibility) and processed.

And then came the 2010 Ministerial Instructions introducing a cap on the number of applications and once more making the post 2010 applications a NEW priority:

The first set of Ministerial Instructions (MI) was issued on November 28, 2008. The second set of MIs, issued on June 26, 2010, introduced a number of changes, including a revised list of eligible occupations, annual limits to the number of applications to be processed in the Federal Skilled Worker (FSW) class, as well as revised eligibility criteria with respect to evidence of official language proficiency and work experience. The second set of MIs also includes instructions for the federal Immigrant Investor Program and the Canadian Experience Class that will be addressed in separate operational bulletins (OB). The Conservatives idea was to limit the backlog of immigration- this was the selling point of bill C-50.

This is also a way to restrict immigration by imposing quotas via caps and therefore diverting the focus of the true motivations of the implementation of this Bill.

As a journalist mentioned and I quote:

Firstly, these amendments turned a relatively neutral system of immigrant determination into a discretionary one where the Minister of the day is given unprecedented discretionary powers, without parliamentary oversight, to issue “instructions” about who should be selected or rejected. (end of quote). 

The statistics are appalling and we need to act to respect the rights of our future immigrants and the ones who have been waiting endlessly when they were promised to have their case processed in no more than 12 months.

A mandamus 
is a legal procedure which commands an individual, organization (eg. government), administrative tribunalquasi-judicial body or court to perform a certain action, to make a decision, to which the agency is required, or for which the agency has discretion, pursuant tostatute.

In order words, applications under all sets of Ministerial instructions are being dealt with differently and and the Minister should be required and ordered to process the files in accordance with the law and not some discretionary powers that could eventually be found unconstitutional.

 

The statistics are appalling and we need to act to respect the rights of our future immigrants and the ones who have been waiting endlessly when they were promised to have their case processed in no more than 12 months.

A mandamus is a legal procedure which commands an individual, organization (eg. government), administrative tribunal, quasi-judicial body or court to perform a certain action, to make a decision, to which the agency is required, or for which the agency has discretion, pursuant to statute.

The basis of the mandamus is all the breaches that were made by the Minister to follow through on files submitted since the first set of ministerial instructions in 2008.

Promises were made to process files in 6-12 months and those promise were broken over and over again.

How can it be justified that an applicant applying under a new set of ministerial instructions enter Canada in less than 12 months when the same applicant with the same profession who applied between 2008 and 2010 be denied processing of his or her file?

How can this be legally justified?

The principal of procedural fairness and equity was overlooked since 2008.since the implementation of the Bill C-5-.. The basis for bill C-50 could even be argued as being unconstitutional. 

Someone, somewhere, somehow, needs to be accountable for the promises that were made to all future and prospective immigrants around the world.

This mandamus might bring as an end result formal policy changes and that is what we are aiming for on a long term basis. But on a short term end, we aim that the Court will give an order to Citizenship and Immigration Canada to take decisions in the case that have been left out and waiting for unreasonable periods of time.

In order words, applications under all sets of Ministerial instructions are being dealt with differently and the Minister should be required and ordered to process the files in accordance with the law and not some discretionary powers that could eventually be found unconstitutional.

The writ of mandamus is the appropriate action and has been used in the past for the specific issues of forcing the government to take action and render decisions in immigration files ( see Dragan v. Canada (Minister of Citizenship and Immigration) (T.D.) [2003] 4 F.C. 189 

As it was mentioned in previous Senate Debates in 2008  by the Honourable Vivienne Poy and I quote:

' In addition, there is a global competition for the best and the brightest in the world, it will make talented individuals think twice about emigrating to Canada, where, the rules are ambiguous. It will also undermine Canada's international reputation as an immigrant welcoming country, which is so crucial to our future.'
